This Privacy Policy (the “Policy”) describes the type of information Healthy Spot LLC, or any of its divisions or affiliates (collectively “Healthy Spot,” “we,” "our" or “us”) collect from and about you when you visit our website (www.www.officialhealthyspot.com or the “Site”), visit or make a purchase at our stores (each a “Store”), or otherwise contact or interact with us through our online service providers (“Online Services”) or offline (“Offline Services”). This Policy applies to all visitors, users, and others who use the Services (“consumers” or “you”). We obtain the categories of personal information we collect from the following categories of sources:
- From You: The information you provide while using the Services whether online or in person at our Stores. We, our service providers, or advertising companies and networks and social media platforms that we work with, may also use various technologies such as cookies, web beacons, pixel tags, log files, HTML5, or other technologies to collect personal information about visitors to, and users of our Site and our Online Services. In particular, we use session replay and similar technology to record and better understand your interactions on the Services. We may also collect personal information through your interactions with our emails and online advertisements. Healthy Spot will not collect additional categories of personal information or use the personal information we collect for materially different, unrelated, or incompatible purposes without providing you notice.
We may use and share aggregated and deidentified information to the extent permitted by applicable law. When we use deidentified information, we maintain and use the information in deidentified form and do not attempt to reidentify it, except to check whether our deidentification processes satisfy the requirements of applicable law.

DISCLOSING PERSONAL INFORMATIONIn the preceding twelve (12) months, we have collected, used, or disclosed the following categories of personal information - identified above in the "Information We Collect" section of the Policy - for the commercial or business purposes described above in the "How We Use Personal Information" section of the Policy. Our commercial purposes include marketing, advertising, and enabling commercial transactions. Our business purposes include other purposes listed, such as performing services, auditing, legal compliance, fraud prevention, and internal operations and improvements.

We may partner with ad networks and other ad serving providers ("Advertising Providers") that serve ads on behalf of us and others on non-affiliated platforms. Some of these ads may be personalized, meaning that they are intended to be relevant to you based on information Advertising Providers collect about your use of the Site and other sites or apps over time, including information about relationships among different browsers and devices. Verification Process and Authorized Agent
Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information.
You may only make a verifiable consumer request related to your personal information twice within a 12-month period. The verifiable consumer request must:

Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. This may include, without limitation, your first name, last name, email address, and phone number. You may also be required to sign a declaration under penalty of perjury that the person making the request is the person about whom the personal information was collected.

Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

If your request is being made through your authorized agent, in addition to the above, please have the agent provide signed permission from you for Healthy Spot to interact with the agent with respect to the requests being made, or in the alternative, please contact us directly to confirm that the agent has the authority to make requests on your behalf. The authorized agent may also submit a valid power of attorney.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account. We will use only personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
Response Timing and FormatWe endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up an additional 45 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
10. DATA RETENTION
We will retain each category of personal information we collect in accordance with applicable laws and as reasonably necessary for our processing purposes set out under this Policy. When it is no longer necessary to process personal information for these purposes, we will deidentify, aggregate, or delete this data to the extent possible.
11. NON-DISCRIMINATIONWe will not discriminate against you for exercising any of your CCPA rights.
12. CHANGES TO OUR PRIVACY NOTICEHealthy Spot reserves the right to amend this Policy at our discretion and at any time. When we make changes, we will update the Policy’s effective date, notify you via email at the last email address that you provided us, and post the updated notice on the Site. The MIND BODY BOWL Benefits Loyalty Program provides Participants the opportunity to receive and redeem loyalty rewards points (“Points”), on an individual basis and solely for their own account. The MIND BODY BOWL Benefits Loyalty Program may be structured to offer certain benefits based on the Participant’s current number of "redeemable" Points (that is, Points that have been received and that have not previously been redeemed).

Sales tax, shipping fees, tips and purchases made with a Healthy Spot gift card do not qualify for points. Third party purchases via Instacart, DoorDash, Amazon etc. do not qualify for points either.

For your purchase to qualify for the MIND BODY BOWL Benefits Loyalty Program, you must be enrolled as a Participant in the MIND BODY BOWL Benefits Loyalty Program and (a) your in-store account must be linked to your online MIND BODY BOWL Benefits Loyalty account at the time of purchase online or your online account registration must be completed within 24 hours of signing up in store; or (b) you must be signed into your MIND BODY BOWL Benefits online account when making an online purchase at www.helathyspot.com. Customers can opt into the program at any Healthy Spot store by letting the team member know they would like to join the program and the team member will then update the customer’s Loyalty Status to “New Member.” The customer will receive an email to verify their email address and set up their account. It is necessary for Healthy Spot to retain your name and email address in order for Healthy Spot to be able to provide these incentives to you. The value of your name and email address are also reasonably related to the financial incentive offered. The value of your name and email address is derived by considering the additional profit generated by Healthy Spot from the collection and retention of customers’ names and email addresses, which is approximately 5%. This additional profit increase was calculated by utilizing historical data from comparable loyalty programs and as advised by the expertise from our loyalty program partner.
